8. Legal Bases for Processing Where GDPR or UK GDPR Applies

Where European Union or United Kingdom data-protection law applies to our processing, we may rely on one or more applicable legal bases, including:

Performance of a Contract

We process information when necessary to provide a course, coaching service, subscription, digital product, or other service you have requested or purchased.

Consent

We may rely on your consent for activities such as:

• optional marketing;

• certain cookies or tracking technologies;

• promotional use of photographs, videos, or testimonials; and

• processing certain sensitive information where explicit consent is required.

Where processing depends on consent, you may withdraw that consent subject to applicable law.

Withdrawal does not make previous lawful processing invalid.

If information is reasonably necessary to provide individualized coaching safely, withdrawing consent to process that information may mean that we cannot continue providing that particular service.

Legitimate Interests

Where permitted, we may process information for legitimate business purposes such as:

• operating and improving our services;

• maintaining records;

• preventing fraud or abuse;

• protecting our systems;

• communicating with existing customers about purchased services; and

• managing our business.

We consider the privacy interests and reasonable expectations of individuals when relying on legitimate interests.

Legal Obligations

We may process and retain information where required to comply with legal, taxation, accounting, regulatory, or other obligations.

9. Marketing Communications

Transactional and service communications are different from marketing communications.

We may contact you without treating the communication as marketing when reasonably necessary to:

• confirm a purchase;

• manage an appointment;

• provide course access;

• address a payment issue;

• respond to your inquiry;

• administer your subscription;

• provide important service information; or

• otherwise provide a service you requested.

Promotional emails or other commercial electronic messages will be sent only where we have an appropriate legal basis, including consent where required.

Where applicable, marketing communications will contain an unsubscribe mechanism.

You may withdraw marketing consent or request that promotional communications stop at any time.

We may retain a minimal record of your opt-out so that we can continue respecting your request.

Unsubscribing from marketing does not necessarily prevent necessary account, transaction, coaching, or service-related communications.

10. Cookies, Analytics, and Similar Technologies

Our website and third-party platforms may use cookies and similar technologies.

These technologies may be used to:

• maintain login sessions;

• remember preferences;

• provide essential website functionality;

• maintain security;

• understand website usage;

• measure site performance; and

• improve our services.

Some third-party platforms may also use their own cookies according to their privacy policies.

Where applicable law requires consent for non-essential cookies or similar technologies, appropriate consent or preference controls will be provided.

You may also be able to control cookies through your browser settings.

Disabling certain essential cookies may prevent parts of the website or course platform from functioning correctly.

11. How We Share Personal Information

We do not rent personal information.

We do not sell personal information for monetary consideration as part of our ordinary business operations.

We may disclose personal information to third parties where reasonably necessary for the purposes described in this Privacy Policy.

Information may be disclosed where reasonably necessary to accountants, lawyers, insurers, consultants, or other professional advisers.

Legal Requirements

We may disclose information when reasonably necessary or legally required to:

12. Advertising Technologies and Sale or Sharing of Personal Information

Get Gymnast Fit does not sell personal information for monetary consideration as part of its ordinary business.

Some privacy laws use terms such as “sale” or “sharing” more broadly and may include certain forms of targeted or cross-context behavioural advertising.

If we use advertising technologies in a manner that legally constitutes a sale or sharing of personal information, we will provide the notices and choices required by applicable law.

We do not knowingly sell sensitive health information.

13. Third-Party Platforms

Our services may depend on third-party platforms, including Thinkific, Wix, Stripe, PayPal, Zoom, WhatsApp, FaceTime, Google services, and other providers.

When you use a third-party platform, that provider may independently collect and process information according to its own privacy policy and terms.

We encourage you to review the privacy policies of services that you choose to use.

We are not responsible for the independent privacy practices of third parties that we do not control.

14. International Data Processing and Transfers

Get Gymnast Fit is based in Nova Scotia, Canada, but serves customers internationally.

Your personal information may therefore be accessed, stored, or processed in Canada, the United States, or other countries where our service providers operate.

Privacy and government-access laws in those countries may differ from the laws where you live.

Where applicable privacy law requires specific protections for an international transfer of personal information, we will use legally recognized mechanisms or safeguards where required.

The location in which information is processed may also depend on the service provider you use, such as a payment processor, course platform, communication service, website provider, or cloud provider.

15. Data Retention

We do not intend to retain personal information indefinitely simply because it was collected.

How long information is retained depends on factors such as:

• the purpose for which it was collected;

• whether you continue to use our services;

• course or subscription access periods;

• whether a coaching relationship remains active;

• the sensitivity of the information;

• accounting and taxation requirements;

• contractual obligations;

• fraud prevention and security needs;

• applicable limitation periods;

• potential or existing disputes; and

• other legal requirements.

For example:

• transaction and payment records may be retained as required for accounting, taxation, and legal purposes;

• course and account information may be retained while access is active and for a reasonable administrative period afterward;

• coaching information may be retained while the coaching relationship is active and for a reasonable period afterward where necessary for legitimate business, safety, recordkeeping, or legal purposes;

• unsuccessful or inactive coaching applications may be deleted or de-identified when they are no longer reasonably needed;

• marketing information may be retained until you withdraw consent or opt out; and

• a minimal suppression record may be retained after an opt-out so that we do not accidentally add you back to marketing communications.

When information is no longer reasonably required, we may securely delete, anonymize, or de-identify it, subject to legal and technical limitations.

16. Data Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the nature and sensitivity of the information under our control.

These may include measures such as:

• access controls;

• password-protected systems;

• reputable payment and technology providers;

• limiting access to information to circumstances where it is reasonably necessary;

• device and account security measures; and

• reasonable procedures for handling sensitive information.

Health and financial information are treated as particularly sensitive.

No internet transmission, electronic storage system, or service can be guaranteed to be completely secure.

If we become aware of a breach involving personal information, we will investigate and take reasonable steps to contain and address it.

Where applicable law requires notification to affected individuals or privacy regulators, we will make the required notifications.

17. Your Privacy Rights

Depending on where you live and which privacy laws apply, you may have rights concerning your personal information.

info@getgymnastfit.com

Please provide enough information for us to reasonably identify you and understand your request.

You may request information about the existence, use, or disclosure of personal information we hold about you and may request access to or correction of that information, subject to applicable exceptions.

You may also withdraw consent to certain uses of personal information, subject to legal or contractual restrictions and reasonable notice.

If information is reasonably necessary to provide a requested service, withdrawing consent may affect our ability to continue providing that service.

• access;

• rectification;

Our services are primarily designed for adults.

We do not intentionally market our general services to young children.

We will handle personal information concerning minors with consideration for its increased sensitivity and applicable legal requirements.

If you believe that a child has provided personal information to us inappropriately, please contact us.

23. Testimonials and Promotional Content

Providing feedback, participating in coaching, or submitting training content does not automatically authorize Get Gymnast Fit to use your personal information, photograph, likeness, video, health information, or progress story for advertising.

Where we wish to use identifiable client material for promotional purposes, appropriate permission will be obtained.

If you have authorized promotional use and later have a concern about future use, contact us at info@getgymnastfit.com.

Removal from previously distributed printed materials, archived content, or material already incorporated into completed campaigns may not always be technically or practically possible, but reasonable requests regarding future use will be considered.

24. Automated Decision-Making

We do not currently make decisions about coaching eligibility, purchases, or access to our services solely through automated processing where such a decision would have a legal or similarly significant effect on an individual.

If this practice materially changes, this Privacy Policy will be updated where required.

25. Changes to This Privacy Policy

We may update this Privacy Policy when our business practices, technology, service providers, or legal obligations change.

The latest version and effective date will be posted on our website.

Where a change materially affects how previously collected sensitive information is used, we will provide additional notice or obtain additional consent where required by law.

Continued use of our services will not be treated as consent to a new use of sensitive personal information where applicable law requires affirmative consent.
